As every year, a fictional case that is taken to the European Court of Human Rights forms the basis of the sixth iteration of the European Human Rights Moot Court Competition (EHRMCC) organized by ELSA International and the European Court of Human Rights (ECtHR). As the first step of the competition, participating students from over 100 universities have to assess the case in written submissions from the angle of the complaining person(s) and from the viewpoint of the member state of the European Convention on Human Rights (ECHR). The assessments of these submissions, carried out by the ECtHR and ELSA International, then decide about the teams’ qualification for the grand final in Strasbourg that consists of several rounds of oral pleadings dealing with the same case. Again, the event’s organizers have chosen a constellation that deals with current developments in European human rights law that confronted students with the following questions: How do compulsory vaccinations that are prescribed by law in a member state have to be assessed in the light of the ECHR? Which rights could be interfered with, and how could such interference be justified?

To offer students the opportunity to prove their legal and rhetorical abilities in a competitive atmosphere, the UNI-ETC, in cooperation with ELSA Graz and ELSA Germany, hosted the so-called Pre-Moot, a practise session for the final in Strasbourg, in Graz for the first time on 19 January 2018. After a welcome address by Dean Univ.-Prof Stefan Storr and introductory remarks by Gregor Fischer (UNI-ETC) and Lea Mayrwöger (ELSA Graz) in the brand-new moot court room of the Law Faculty of the University of Graz, students of the five Pre-Moot teams pulled out all the stops in a morning and afternoon session to pursue the juries consisting of teachers from all participating universities and Sabrina Wittmann (ECtHR) of their legal opinion. In the process, critical remarks from the “judges” had to be dealt with as well as the pressing time limits.

After the successful pleading sessions, all participants could reflect on the busy day of legal argumentation and make new friends from all across Europe. The résumés from teachers and students alike were thoroughly positive – and a rerun in 2019 seems very likely.  Graz-Premiere: Pre-Moot für die EHRMCC – die Impfpflicht, die Menschenrechte und die Kunst der Rhetorik

Im Zentrum der in diesem Semester bereits zum sechsten Mal ausgetragenen European Human Rights Moot Court Competition (EHRMCC) steht ein fiktiver Fall vor dem Europäischen Gerichtshof für Menschenrechte, den die teilnehmenden Studierenden von über 100 Universitäten zuerst in Form von Schriftsätzen aus Sicht der Beschwerdeführer und jener des betreffenden Vertragsstaates der Europäischen Menschenrechtskonvention (EMKR) zu bearbeiten haben. Diese zentral in Straßburg bewerteten Written Submissions entscheiden sodann über den Einzug ins Finale, das direkt am EGMR ausgetragen wird, wo der Fall dann mündlich in Oral Pleadings zu verhandeln ist. Wie jedes Jahr wurde von den Organisator*innen am EGMR und von ELSA International eine aktuelle Thematik gewählt, die folgende Fragen aufwarf: Wie verhält sich eine staatlich verordnete Impfpflicht zur EMRK? In welche Rechte wird hier eingegriffen, und wie lässt sich ein solcher Eingriff möglicherweise rechtfertigen?

Um den Studierenden die Möglichkeit zu geben, ihre rechtlich-analytischen und rhetorischen Fähigkeiten vor dem Finale in Straßburg in „Turnieratmosphäre“ unter Beweis zu stellen, organisierte das UNI-ETC gemeinsam mit ELSA Graz und ELSA Deutschland am 19. Jänner 2018 zum ersten Mal den sogenannten Pre-Moot, eine Übungsrunde für das Finale in Straßburg, in Graz. Nach Grußworten von Dekan Univ.-Prof. Stefan Storr, Gregor Fischer (UNI-ETC) und Lea Mayrwöger (ELSA Graz) im neuen Moot Court Raum der Fakultät zogen die Studierenden der fünf anwesenden Teams in einer Vor- und einer Nachmittagsrunde alle Register, um die von Vertreter*innen aller teilnehmenden Universitäten und Sabrina Wittmann (EGMR) besetzen Jurys von ihrer Rechtsmeinung zu überzeugen. Dabei mussten durchaus kritische Zwischenfragen vonseiten der „Richter*innen“ ebenso gemeistert werden wie die knappe Zeit für den Vortrag der Argumente. Hierbei schlugen sich die Teams durchwegs gut, wie am Ende der Verhandlungen von den Jurymitgliedern festgehalten wurde.

Im Anschluss an die Verhandlungen durften die Erfahrungen des Pleading-Tages bei einem gemeinsamen Abendessen ausgetauscht und internationale Freundschaften geschlossen werden. Die Resümees vonseiten der Studierenden, aber auch der angereisten Lehrenden fielen dabei durchwegs positiv aus – einer Neuauflage im Jahr 2019 steht damit nichts im Wege. Das Team des UNI-ETC bedankt sich ausdrücklich beim Dekanat der Fakultät für die Unterstützung und bei Michael Otti von ELSA Graz für die gute Zusammenarbeit!
